Judicial inefficacy results in increased impunity and social unrest in response to the absence of reparation for the damages sustained due to crime. In light of this situation, the criminal justice system in Mexico has been reformed and converted into an adversarial system respectful of the human rights of all those involved in the criminal drama.
The June 2008 reform establishes alternative outcomes/alternative pathways for the differentiated resolution of conflicts. This, thus, gives rise to opportunities for repairing, via alternative methods, the damage caused by crime. This form of conflict resolution is known as restorative justice, the origins of which are found in various social movements which emerged from the social unrest provoked by the inefficacy of the State in ensuring or providing justice, above all in matters related to the reparation of damage caused by crime.
