As a science, psychology is regulated by a specific lex artis, which implies that healthcare professionals providing clinical psychological care must act in accordance with certain procedures inherent to the discipline, from which emanate a series of legal obligations. Non-compliance with these civil obligations, which amounts to malpractice, brings with it a responsibility in this area, given the damage to legally protected rights that this involves. In this sense, the clinical psychologist must take responsibility for any damage caused by the acts or omissions forming part of their conduct. The present article seeks to analyse the possible hypotheses under which the professional service provider in the area of clinical psychology may become civilly liable. It also aims to emphasize the main obligations with which they must comply in the exercise of their profession and which they must observe in the course of their work, prudently, diligently and in full knowledge of their scope of action.
