The present study sets out the concrete aspect of civil liability in Spain derived from unlawful interferences in the intimacy of the other spouse. This is independent of the recovery of non-material damages permitted under civil or criminal jurisdiction, wherein Article 1 of Organic Law 1/1982, dated 5 th May, for the civil protection of the right to honour, personal and familial intimacy and personal likeness, establishes that its criteria will be equally applicable for the determination of civil liability for the crime.
