This study aims to analyse the notion of recoverable damages adopted in the Civil and Commercial Code of the Republic of Argentina, namely the infringement of rights or interests non-conflicting with the legal system or the damaging consequences of this infringement.

The practical implications of this analysis can be seen in the quantification of the damages caused to psychophysical integrity or by a person’s death, namely whether the infringement itself is compensated (in the abstract) or whether the property and non-property consequences for the injured party are compensated (in concreto). Argentine doctrine and jurisprudence are analysed to conclude that the Civil and Commercial Code considers a major damage event, although only those property and non-property consequences that said infringement causes to the victim are recoverable.
