This article addresses the treatment that has been given to egalitarian marriage legislation and its constitutional interpretation in Mexico through the exercise of constitutional control, emphasizing the action of unconstitutionality 02/2010, filed by the General Attorney of the Republic in office at that time.

This study is built from a perspective of legal relationship, leaving aside the heterosexuality of spouses, and the reproductive object of the couple, with the aim of regulation through legal norms and principles, according to needs of social reality, not leaving aside human dignity.
