Abstract

This article presents an analysis of the educational function in the process of the constitutional construction of the State of Aguascalientes. It is based upon two documentary sources in order to understand the subject in the current national situation and Aguascalientes' historical formation, and to analyze the constitutional laws of this State. The analysis shows that the formation of the educational function of the State, culminating at the highest point of creating the right to education in the legal order of Aguascalientes, is related to a large process of political and legal organization of Mexico, on the one hand, and the recognition of Aguascalientes as a federal entity at a constitutional level, on the other. Both processes were originally made in its origins under the influence of liberal thought and, in the contemporary times, according to the global movement characterized by the purpose of guaranteeing the right to education. The entire achievement of the right to education demands understanding of its historical development and recognition of the importance of law content, due to its ontological link to the dignity of a human being and his rights; that is the basis of a government improvement and, therefore, a better social participation in education.
