Abstract

In the year 2007 the reform to the Distrito Federal Penal Code is passed and published with regards to abortion, with it, the depenalization of the crime of abortion was validated, modifying thus the penal type and the concept of abortion itself; therefore, in the D.F the practice of interrupting the product in the first twelve weeks of pregnancy became legal. This paper is an analysis of the national and international legal foundations that protect the fundamental right to life, as well as the theoretical, biological, theological and legal argumentations which were put forth in the debates that led to the passing of the amendments to the articles both of the Distrito Federal Penal Code and the Distrito Federal Health Act, the central topic of the debate and analysis was the fundamental right to life during the pregnancy period.
