The new constitutional paradigms about the human rights erected from the constitutional reform of June 10, 2011, and for international and national resolutions, confer any authority the obligation to protect and maintain the observance of human rights, which have been consolidated as control parameters regularity of constitutionality. Hence the importance of administrative authorities and not only judicial authorities, aware of the scope of this duty, and as its function is essential to ensure the effectiveness of the legal system. Any prohibition or restriction to exercise administrative control of constitutionality, significantly affected the protection and realization of human rights authority.
