CASTILLA, Karlos. Pro personae principle in Justice Administration. Cuest. Const. [online]. 2009, n.20, pp.65-83. ISSN 1405-9193.
The implementation of the standard system of human rights by national courts is a core issues to ensure respect for and observance of them in all circumstances. For it to be applied, legal "agents" should know and use different principles for the interpretation of human rights beyond traditional methods, since fundamental rights claim a number of different hermeneutics patterns to those usually applied to interpret other legal norms. Here, the input provided by the appliance of the pro person's principle on the interpretation and appliance of the law with an eye on the bigger and better protection of the people, is certainly interesting and useful, as it does not undermine or violate the constitutional system or generally the rule of law and it ensures that individual rights are better protected and guaranteed.
