Resumen

FERNANDEZ ROZAS, José Carlos. La Constitución mexicana y el arbitraje comercial. Cuest. Const. [online]. 2007, n.16, pp.159-204. ISSN 1405-9193.

The fact that the State of Mexico has the exclusive privilege of the jurisdiction is not an obstacle for citizens to supply this activity with others private procedures if they are voluntary accepted even if it is a resiudicata matter. The arbitration does not suppose a substitution of the exclusive jurisdictional function of the State, neither a lack of this function in he rent to so vereignty. The Mexican legal order admits the possibility for citizens to choose the solution for their social and legal problems between the jurisdictional and non-jurisdictional way, mainly the arbitration. The right of every citizen to obtain a due process of law from judges and tribunals exercising their rights and interests is not an obstacle to choose a non-jurisdictional solution.

Palabras llave : Mexican Constitution; arbitration; jurisdiction; due process of law.
