This essay, in addition to offering information on the evolution of the right to education at the international level, and the way this right is established in Mexico's legislation, examines two particular aspects: on one hand, its enforceability and the problems faced; and on the other hand, the relation educational policy should have with the right to education, given that this right is based on the state's obligations in education. The author concludes by formulating a proposal for the National Institute for the Evaluation of Education to reorganize its indicators in this regard and facilitate the enforceability of the right to education. The article extends an invitation to educational researchers to include these topics on their research agendas.
