The Mexican Constitution 1917’s originality was that it took the land and the natural commons out of the market circuits, safeguarding them as a nation’s public patrimony. For this, the constituents rescued the Spanish monarchy’s tradition of public law, nourished by the persistence of community socialities. This text explains the reason for this event, anomalous in the liberal legal tradition.
