Abstract

This paper explores the implications of deliberative democracy for the judicial enforcement of social rights. In the first part of the paper, the author critically examines the two most common views of democracy that judges use, when they deal with cases concerning social rights, namely, the pluralist and the "rousseauean" views of democracy. In its second part, the author explores the implications of an alternative, deliberative notion of democracy, when dealing with social rights.
