This work deals with the present changes within the relation between citizenship and migration in the case of indigenous who migrate from Oaxaca to the United States. The article proposes that within the political systems in Oaxaca emerge a set of diverse political responses as well as legal changes as a result of transnational migration. These changes mean that citizenship may be studied beyond the State as a movement from below. In this sense, transnational migration is an alternative against social and political exclusion on both sides of the border.
