There are two possible ways to recognize migrants' rights: the expansion of citizenship and the recognition and enforcement of human rights. This paper evaluates these possibilities and outlines the different political traditions of citizenship and its ontological tendencies towards exclusion, as well as the ways these rights are taken up to expand citizenship. It highlights the proposal of post-citizenship, which seeks to transcend citizenship's proclivity to exclusion and focus on the universal, humanistic nature of rights, and proposes a reformulation of the hegemonic concept of human rights in order to extend them to documented and undocumented migrants.
