This article examines the different factors under which, the agents related to human genome research, when they cope with IP fragmentation, can (or not) to achieve cooperation agreements in order to avoid the tragedy of anticommons. It is considered as key factors: the complex nature of gen/function; the evolution of formal and informal property rights, and; the characteristics of agents.
