Abstract

The paper presents various points of the theory of the State of Carl Schmitt that are relevant to a genealogical account of the political in modernity; so that addressing the issue is at the same time, systematic and historical. Based on the constitutional arguments of the author, explains the involvement of State and the political, as well as the concept of "unity factor" and its relationship to sovereignty. It is stated that the thought of Carl Schmitt emerges of widespread civil war in Europe, whose consequences must be thought in contemporary political theory. The last part presents a critical test of the theory of Schmitt on the political.
