Abstract

This article approaches the responsibility that the Political Constitucion of Mexico imposes to the State, in regards to the exploration, exploitation, and oil industrial process, taking into account an important part of the latter. In a very brief period of time, the constituent assembly that developed the precepts which belong to the oil matter. Could ratify their concerns as the strategic importance of the Hydrocarbons increased disproportionately among the international scene. On the other hand, and at the same time, the international oil companies showed their economic and political capacity to act against those who hindered or obstructed their operations. Thus, the recently proposed Energetic Reform ignores the risks taken in the past and it is unconstitutional. Likewise, in case that private investment in Petroleos Mexicanos is allowed, the oil institution could remain as a guarantee of an unpayable debt, not withstanding the national economy rests upon it.
