The aim of this work is to establish the factors that influence the aptitude of the public Spanish universities to generate patents. For it, we took the information of 47 universities, applying, first, a factorial analysis that might influence the development of university patents, which allow two components to be distinguished, which are in use later as independent variables from the logistic binary regression that seeks to estimate the determinant factors for the development of patents by the universities. As a result, we can say that: as higher and better the research quality, the office experience about technological transfer and dimension, major is the probability of which the universities patent.
