This article has as purpose to examine the way in which the right for a quality attention and education for early childhood has developed based on an analysis of the different educational and early child care policies (educación y atención de la primera infancia, EAPI) in the European systems, and also how it can be monitored, particularly in the inclusion processes for children in situation of risk and social exclusion. The author concludes that the current situation for what regards to education and early child care presents distinctive features in most of the countries of the European Union, this means that they deal with the problem in very different ways and with dissimilar arguments that do not always take into account the rights of the youngest although they determine the scope of equity in the EAPI's supply.
