This paper aims to analyze the relevance of transparency within contemporary society. It underscores that acknowledging transparency as a public policy has implied its linkages to restricted openness and publicity in its way to structuring with the values and practices of modern democracy, as a means that allows the enforcement of the right to access to information, combining institutional opportunities and limitations. The working hypothesis is that transparency controls the power of the State while, nevertheless, cannot be explained by itself, but in relation to secrecy and from the perspective that publicity enables citizens to have access to, learn about and evaluate information produced by governmental offices, understood conceptually as public policies. This article uses the methods of interpretation and legal exposition to produce normative theoretical knowledge. Conclusions dwell on the usefulness of transparency to institutionalize an open, accessible, public and responsible power.
