The author develops a critical analysis of the controversial positions arisen around the constitutional amendment on native culture and native rights made a few years ago by the Mexican·-Federal Legislature.

This essay reviews the main lines of such reform and its dilernmas, as well as the contrasting arguments both in the San Andrés Agreements and in the Concord and Peacemaking Commission (COCOPA), to identify which is the nature of the dissent and which are the underlying ideas about State in the abovementioned controversy.
