French legal institutions' history demonstrates a blatant exclusion of women from political and civic life. Women had to struggle for their rights for this situation to change. Legal initiatives to grant women's rights have thus been taken petit à petit by French legislators. One of the first of these laws is the one that grants equal access to primary education to girls in 1801. The recognition of women's rights happens gradually. Thus, it would be interesting to analyze in which measure there are women's rights in French Law. Indeed, women's rights are protected generally but also specifically. However, the persistence of inequalities in society and the emergence of non categorical rights question the utility of using measures of positive discrimination. This comes to show that the fight for equality must continue. The qualitative methodology will be used. Documentary research, the study of jurisprudence and legislation will support the information relating to the subject.
