This article raised the difficulties that air transport law has had to date present. The flexion point was Sentence of the Court of Justice of the European Communities (2002) well-known as "open skies". The legal analysis becomes from the slope of the distribution of competitions between the Member States and the European Community. While the Treaty of Lisbon does not enter in force and we have a list of competitions it express, the doctrine AETR, is the unique one that serves as measurement to detimit until where it can negotiate the Union in his relations with third States. Parallel to this fact, the creation of the Single European Sky supposes a challenge and a pulse for the 27 Member States, because it means a loss of sovereignty and a reorganization of his airspace.
