The present article deals from the Marxist perspective, with the protection the works that are regulated by the Intellectual Property Law. The author begins with a reference on the historical origin ofthe intellectual property, from the right of reproduction ofintellectual works known like "copyright". Later, makes the analysis of the juridical guardianship of the intellectual work, in which is done special reference to the penal guardianship of the author's patrimonial rights, in that it is criticized and propose reforms to the above mentioned juridical regulation.
