Resumen

SANTOS AZUELA, Héctor. Sistema y genealogía del derecho sindical. Bol. Mex. Der. Comp. [online]. 2003, vol.36, n.106, pp.115-146. ISSN 2448-4873.

The goal of this essay is to study the challenges and perspectives of trade-union's legal regime, in face of globalization. In the first place, the author explains the origins and development of "trade-unions law", referring to the different definitions of this concept and to its most important institutions, such as the right to form these organizations, the right to strike and collective bargaining. Secondly, he refers to the trend toward the "flexibilization" of the labor market (and of trade-unions legal regime) that has emerged in the context of globalization. Moreover, he tries to determine which is the legal nature of "trade-unions law", and discusses the role of this area of the law today.

Palabras llave : trade unions; strike; collective bargaining; globalization.
