The present paper addresses the issue of employment offering. This figure as known, has been created by the Mexican Supreme Court. Speaking of the labor procedure is a very important factor for continuing or not the employment relationship when it has commenced a lawsuit for wrongful dismissal. The analysis of the issue allows us to take position on its regulation or in the Federal Labor Act and Bureaucratic Labor Act. From our perspective, it is important that this figure is regulated by law, especially because there are various arguments and case law criteria that are opposed, so if its regulation is achieved in the law of the new pronouncements matter would come to enrich and not just as happens, but until the Court creates a new case law criteria and make the sum of them.
