The South American region is the most affected area in the world in terms of arbitration claims relating to private investments. Attended the forum on the subject is the ICSID of the World Bank, however is not the only one. In our region, the negotiations on a dispute settlement mechanism within the UNASUR, had been developed. The following is a work focused on some problematic aspects of the protection of investment and the arbitration system, with its comparison with projects for the creation of a Centre for Dispute Settlement on Investment of UNASUR currently under negotiation.
