In the context of unequal relations that the southern countries live, the national States acquire special obligations to protect and guarantee human rights. Under this premise, we analyze the case law of the Inter American Court of Human Rights, which, from a postmodern point of view recognizes the legal particularities of human rights, both individual and collective, and helps to achieve reinforcement for formal guarantees legally recognizes, as well as the empowering of communities and indigenous peoples through prior consultation, as a mechanism to effectively involve indigenous peoples in the decision making processes regarding their natural resources.
