The paper has as a central objective to plant the possibility of the emergence of a human right derived from the informative self-determination and inmersed in the private life of people who intend to exclude them from the obligation to participate in technological processes where their private life, their intimate life, your own image and your personal data are compromised, analyzed, explored and abused by public and private organizations. The central axis of this paper will be linked to the prediction and psychological segmentation of behaviors and interests, as well as the algorithmic segmentation with porpuse of profiling for varios comercial, political, surveillance, among others and in the same way to the prescriptive analytical tending to the elimination of human participation in decisión making. It is proposed, after reviewing the scope and impacts of the new artificial intelligence and machine learning tecnologies, to explore the scope and effects of the law, proposing the State´s guarantee to monitor and avoid discriminatory effects due to the refusal of consent to participate in these processes linked to any data processing.
