Resumen

MUNOZ MENDIOLA, Julio César. The Judicial Rationality in Constitutional Stage. Probl. anu. filos. teor. derecho [online]. 2021, n.15, pp.605-635.  Epub 31-Mayo-2022. ISSN 2448-7937.  https://doi.org/10.22201/iij.24487937e.2021.15.16134.

This paper defends an intermediate position on the rationality of a constitutional judge’s decision making, through the development of a theoretical model called the cognitive restrictor thesis, which is characterized by a series of objective parameters that cognitively construct and guide the decision making process in a constitutional venue, with the purpose of establishing a procedural rationality that reduces the spaces of subjectivity and arbitrariness of the constitutional judge.
