The indigenous peoples of Mexico wage an ongoing struggle to claim their rights, a situation that is repeated throughout the rest of Latin America. One of these rights is the right to self-representation. Thanks to their demands, international law, and the advancement of human rights, there has been some progress in this field. However, it cannot be stated that there is currently a link between state law and indigenous law in Mexico. The paper’s point of departure is the assumption that one of the causes that has not favored this coordination lies in the way in which the law is addressed, understood, and interpreted, which continues to be based on classical and contemporary theories. Within this context, this paper aims to analyze these perspectives and identify whether they in fact marginalize indigenous law or they might enable its inclusion at a certain point. .
