The main subject of this article is the juridical evolution of the abortion in Mexico. The abortion must be at tended by the State as a public health problem. Its penalization has been totally inefficient to lower the high rate of clandestine abortions that in many cases end into irreversible damage or death of many women socially helpless. The non-penalization of some abortions doesn't imply to promote this fact; instead, its penalization means a serious violation to the fundamental rights of the women; At the present time the juridical and scientific debate tends to specify if an abortion harms the life of a person or just harms the one of an embryo, which at his/hers 12 weeks hasn't acquire the condition of human being because of the lack of nervous connections and functions that are necessary to acquire such condition. The tendency of most of the countries is directed to the non-penalization of the abortion.
