This article reflects the results of this author's research on topics related to Tort Law, from the perspective of Civil Law in Cuba. An analysis of the different theories dealing with the conceptualization of compensatory damages in contracts with the aim of determining the desired position regarding its regulation in the Cuban legal system. In this respect, penalties are specified for the purposes of contractual tort claims treated as positive or negative interest in cases such as breach of contract, breach of contract, contract inefficiency and termination or pre-contractual liability. In addition, the concepts of emergent damage and loss of earnings are treated as part of broader concept of tort law. The theoretical and comparative law study conducted supports the conclusions reached.
