It analyzes the configuration of the intergenerational historical discourse around the chiapaneco lawyer Emilio Rabasa Estebanell, who identifies him as an ideologist and influencer of the Political Constitution of 1917. Explanations of the origin and strengthening of this constructed image are offered, by exploring from the perspective of the historical subject, in his formative background, his academic, legal and employment trajectory. The assessments of his legacy, expressed in the Constituent Congress of Querétaro, are also reviewed, since there his archetype took on relevance for posterity. His critical inclination (after his exile) reflected in journalistic publications, personal communications, cathartic content, and participations with the legal guild, in which he expressed corrections to constitutional issues, is revised. These dimensions allow to identify that his works did influence various aspects of Magna Carta; but that his thinking and posture were transformed towards criticism of the Constitution, before and after its enactment.
