The paper describes the political crisis and analyses the scope, limitations, influence and legacy of Cadiz legislation in New Spain. In addition to the historiography of the subject and the period, it is based on the political history of education. The Cadiz educational project is important, not because of its implementation and results, but because of its legacy: laicism, gratuitousness, universalization. The work recovers the political context of Cadiz’s educational proposals, an aspect that is generally omitted by historiography. It is concluded that the first teaching in the Constitution of 1812 was conceived in accordance with liberal political approaches, which had a profound influence on New Spain.
