The legal research of mexican budgetary judicial order did not have any development for more than 70 years cause of the permanency of one political party in power. During that period the approval procedure of the Budget Disbursement, cornerstone of budgetary law, become a simple administrative procedure without any discussion among President and Parliament. At the end of twentieth century and beginning of the twenty first, political party in power changed and different problems related with public spendingjudicial order came up. The veto to the Federal Budget Disbursement is not irrelevant in this new situation. The article compares both positions about it, the one in favor of veto, assumed by our National Supreme Court, and the one that refuses this faculty to the president, which is the one that the author supports.
