This paper researchs different modalities of interpretation and application of free informative self-determination principle. Interpretations of European Justice Court have been diversified in Spain and Italy. Although Spain displays a more similar interpretation to European model, it has found autonomy in specific cases. On the other hand, the nationalist legal culture of Italy has followed an interpretation and particular application development similar to the custody property principle. The author's aim emphasizes the importance of the substrate reference in which a specific right is going to be applied. The comparison determines the acceptance of different scientific autonomy of each country and the profit of a common base that can be obtained with a programmatic and particularly scientific way.
